4. Eligibility and Account Requirements

You must be at least 13 years old to use this App. If you are under 18, you must have parental or guardian consent to use the Service.

4.2 Instagram Business Account Requirement

  • Have a Facebook Page linked to your Instagram account

6. Instagram and Facebook Integration

Maximum Liability: In no event shall our total liability exceed the amount you paid to TechPolaris in the 12 months preceding the claim.

  • Instagram or Facebook platform changes, downtime, or restrictions
  • Content violations that result in your Instagram account being suspended
  • Loss of followers, engagement, or reach due to platform algorithm changes
  • Actions taken by Instagram or Facebook against your account

12. Indemnification

You agree to indemnify, defend, and hold harmless TechPolaris, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post through the App
  • Your violation of Instagram or Facebook policies

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

  • Disconnecting your Instagram account from the App
  • Contacting us at support@techpolaris.net
  • Following the account deletion process in the App settings

13.2 Termination by TechPolaris

We may suspend or terminate your access to the App immediately, without prior notice, if:

  • You violate these Terms of Service
  • You engage in fraudulent or illegal activities
  • Your use of the App poses security or legal risks
  • Your payment fails or your account is past due
  • We are required to do so by law
  • We decide to discontinue the Service

13.3 Effect of Termination

Upon termination:

  • Your right to use the App immediately ceases
  • Scheduled posts will be cancelled
  • Your data will be deleted within 30 days (see Privacy Policy)
  • You remain liable for any fees owed prior to termination
  • Sections of these Terms that should survive termination will remain in effect

14. Changes to Terms of Service

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date at the top of this page
  • We will notify you via email for material changes
  • We will provide notice within the App
  • Changes become effective 7 days after posting (unless otherwise stated)

Your continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree with the changes, you must stop using the App and delete your account.

15. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before filing any formal dispute, you agree to first contact us at legal@techpolaris.net to attempt to resolve the issue informally.

15.3 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TechPolaris regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, pandemics, or failures of third-party services.

16.6 Language

These Terms are provided in English. In case of any discrepancy between English and Arabic versions, the English version shall prevail.
